These Terms of Service (the “Terms”) constitute a legally binding agreement between you and InstaHome (“we,” “us,” or “our”). These Terms govern your access to and use of the InstaHome mobile application, website, AI-powered tools, content, subscriptions, Credits, and related products and services (collectively, the “Services”).
By accessing or using the Services, creating an account, or purchasing a subscription or Credits, you acknowledge that you have read and understood these Terms and agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Services.
1. Eligibility
You must be at least 13 years old, or the minimum age required by applicable law in your country, to use the Services.
If you are under the legal age of majority in your jurisdiction, you may use the Services only with the permission and supervision of a parent or legal guardian.
By using InstaHome, you represent that you are legally permitted to enter into these Terms or that your parent or legal guardian has agreed to them on your behalf where required.
2. User Accounts
Certain features may require you to create an InstaHome account.
You agree to:
- Provide accurate, current, and complete information.
- Maintain the confidentiality and security of your login credentials.
- Not share your account with unauthorized persons.
- Notify us if you become aware of unauthorized access to your account.
- Be responsible for all activity conducted through your account, to the extent permitted by applicable law.
We reserve the right to suspend, restrict, or terminate your account if we reasonably believe that you have violated these Terms, compromised the security or integrity of the Services, or used the Services for fraudulent, unlawful, or unauthorized activities.

3. Description of the Services
InstaHome is an AI-powered interior and exterior design platform.
Depending on the features available in your version of the Services, InstaHome may allow you to:
- Upload photographs of interior and exterior spaces.
- Generate AI-powered interior and exterior design concepts.
- Generate photorealistic renders.
- Transform sketches or 3D models into realistic visualizations.
- Explore and apply interior design styles.
- Visualize different colours, materials, flooring, walls, furniture, and layouts.
- Clean, organize, redesign, or visually modify spaces using AI.
- Replace or modify selected objects or areas within an image.
- Use reference images or styles to generate design concepts.
- Save, edit, organize, download, and share generated designs.
- Access additional AI-powered tools and features.
- Access premium functionality through subscriptions or credits.
Features may be added, modified, limited, or discontinued as the Services evolve.
4. AI-Generated Designs and Results
InstaHome uses artificial intelligence and may rely on third-party artificial intelligence models and service providers to generate images, recommendations, visualizations, and other outputs ("AI Outputs").
AI Outputs are generated based on user inputs, uploaded images, selected preferences, and other available information.
Because of the nature of generative artificial intelligence:
- AI Outputs may contain inaccuracies, distortions, inconsistencies, or errors.
- Generated designs may not accurately represent dimensions, proportions, colours, materials, lighting, structural conditions, or real-world feasibility.
- AI Outputs may differ even when identical or similar inputs are used.
- AI Outputs may not be unique.
- Other users may receive identical or similar AI Outputs.
We do not guarantee that any AI Output will meet your expectations.
InstaHome does not guarantee the accuracy, reliability, completeness, uniqueness, or suitability of AI-generated results.
5. Design and Professional Advice Disclaimer
InstaHome is intended for design inspiration, visualization, entertainment, and creative purposes.
AI-generated designs are conceptual visualizations only.
They are not architectural plans, engineering drawings, construction documents, safety assessments, or professional architectural, engineering, electrical, plumbing, structural, financial, legal, or other professional advice.
Before undertaking renovations, construction, purchasing materials or furniture, modifying structures, or making other significant decisions based on an InstaHome visualization, you should independently verify the relevant information and consult an appropriate qualified professional where necessary.
You remain responsible for decisions made based on AI Outputs.
6. User Content
"User Content" includes photographs, images, sketches, 3D models, text, prompts, reference images, selections, and other materials you submit to InstaHome.
You retain ownership of your User Content.
By submitting User Content, you grant InstaHome a worldwide, non-exclusive licence to host, process, reproduce, display, modify, and otherwise use the User Content to the extent reasonably necessary to:
- Provide the requested Services.
- Generate AI Outputs.
- Operate and maintain the Services.
- Prevent fraud, abuse, and security incidents.
- Improve the Services in accordance with our Privacy Policy and applicable law.
Where permitted by applicable law and as described in our Privacy Policy, we may use de-identified or aggregated information derived from User Content and related use of the Services to improve, maintain, and enhance our AI-powered features and Services. Where required by applicable law, we will obtain your consent before doing so. This licence does not transfer ownership of your original User Content to InstaHome.
7. Rights and Permissions for Uploaded Content
You are responsible for ensuring that you have the necessary rights and permissions to upload and process User Content through InstaHome.
By uploading User Content, you represent that:
- You own the content or have permission from its owner to use it.
- Your use of the content does not violate copyright, trademark, privacy, publicity, contractual, or other third-party rights.
- You have any permissions required for identifiable individuals appearing in uploaded content.
- Where applicable, you have permission to use photographs or visual representations of property that you do not own.
- The content does not violate applicable laws or these Terms.
You should not upload confidential or sensitive material that you are not authorized to process through the Services.
8. Ownership and Use of AI Outputs
Subject to these Terms, applicable law, and any rights belonging to third parties, you may use AI Outputs generated through your InstaHome account for personal purposes.
Where permitted by the applicable subscription, feature, or licence presented within the Services, AI Outputs may also be used for commercial purposes.
Because AI-generated content may not be unique, InstaHome does not guarantee that an AI Output is eligible for copyright, trademark, or other intellectual property protection in any particular jurisdiction.
You are responsible for determining whether your intended use of an AI Output complies with applicable law and third-party rights.
InstaHome does not guarantee exclusive ownership of any AI Output.
9. Acceptable Use
You agree not to use InstaHome to:
- Upload, create, or distribute unlawful content.
- Upload content that infringes intellectual property or privacy rights.
- Generate fraudulent, deceptive, defamatory, abusive, hateful, obscene, or otherwise unlawful material.
- Harass, threaten, exploit, or harm another person.
- Exploit or harm minors.
- Impersonate another person or organization.
- Upload malicious software, viruses, or harmful code.
- Attempt to gain unauthorized access to InstaHome systems.
- Reverse engineer, decompile, disassemble, or otherwise attempt to obtain the source code of the Services except where expressly permitted by law.
- Circumvent security, subscription, advertising, usage, or credit limitations.
- Manipulate rewarded advertising systems to obtain unauthorized credits.
- Use bots, scripts, automation, scraping, or similar methods to abuse the Services.
- Resell or redistribute access to the Services without our authorization.
- Use InstaHome for any activity prohibited by applicable law.
We may restrict or terminate access when we reasonably believe these requirements have been violated.
10. Subscriptions
Certain InstaHome features require a paid subscription.
InstaHome currently offers subscription options that may include:
• Weekly Pro Plan Subscription
• Annual Pro Plan Subscription
The exact price, currency, subscription benefits, promotional pricing, applicable taxes, and billing terms will be displayed before you confirm your purchase.
Prices may vary by country, platform, currency, taxes, promotional offers, or applicable app-store pricing policies.
Where required by law, we will provide appropriate notice of changes to subscription pricing.
11. Automatic Renewal and Cancellation
Unless otherwise stated at the time of purchase, subscriptions automatically renew at the end of each subscription period until cancelled.
For subscriptions purchased through the Apple App Store or Google Play, payment, renewal, cancellation, and applicable refunds are handled according to the policies and settings of the relevant platform.
You can manage or cancel your subscription through the account settings of the platform through which you purchased it.
You should cancel your subscription before the applicable renewal deadline shown by the relevant platform if you do not want it to renew.
Deleting the InstaHome application does not necessarily cancel an active subscription.
Following cancellation, premium access will generally remain available until the end of the already-paid subscription period, subject to applicable platform policies and law.
12. Refunds
Purchases and subscriptions made through third-party platforms such as the Apple App Store or Google Play are subject to the refund policies of those platforms.
Except where required by applicable law or the applicable platform's policies, subscription payments and digital services that have already been provided may be non-refundable.
Nothing in these Terms limits mandatory consumer rights that cannot legally be excluded.
13. Credits
Certain AI-powered features may require virtual credits ("Credits").
The number of Credits required may depend on the feature, generation type, processing requirements, or other factors.
The applicable Credit cost will be displayed within the Services where appropriate.
Credits:
- Are digital units intended solely for use within InstaHome.
- Have no cash or monetary value outside the Services.
- Cannot be redeemed for cash.
- Cannot be transferred or sold between users unless InstaHome expressly permits it.
- May be subject to expiration depending on how they were obtained and the conditions displayed when issued.
- May be subject to different rules depending on whether they were purchased, included with a subscription, provided promotionally, or earned through rewarded advertisements.
We may adjust the Credit requirements for future uses of AI-powered features. Any changes will not retroactively alter completed transactions.
14. Free and Promotional Credits
InstaHome may occasionally provide free or promotional Credits.
Promotional Credits may be subject to:
- Expiration dates.
- Daily or account-based limits.
- Feature restrictions.
- Geographic availability.
- Promotional eligibility requirements.
We may modify, suspend, or discontinue promotional Credit programs, subject to applicable law.
Promotional Credits have no cash value and cannot be exchanged for money.
15. Rewarded Advertisements
InstaHome may allow users to voluntarily watch advertisements in exchange for Credits ("Rewarded Ads").
Where this feature is available:
- Users may watch up to three (3) rewarded video advertisements per day.
- Completing an eligible Rewarded Ad may provide Credits for use within InstaHome.
- The number of Credits awarded will be displayed within the Services.
- Rewarded Ads are optional.
- Availability may depend on country, device, advertising provider, inventory, account status, or technical conditions.
- Reaching the daily limit does not guarantee that three advertisements will always be available.
- Attempting to manipulate, automate, falsify, or otherwise abuse Rewarded Ads may result in Credits being withheld or removed and may lead to account restrictions.
- The daily limit, availability, and rewards associated with Rewarded Ads may change as the Services evolve, subject to applicable law.
- Third-party advertising providers may process certain information in accordance with their own privacy policies and our Privacy Policy.
16. Intellectual Property
The InstaHome application and Services, including their software, source code, interface, UX/UI design, logos, trademarks, graphics, text, databases, features, and other proprietary materials, are owned by InstaHome, its licensors, or other applicable rights holders.
Except for the limited rights expressly granted under these Terms, no right, title, or interest in the Services is transferred to you.
You may not copy, reproduce, modify, distribute, sell, sublicense, reverse engineer, or commercially exploit the Services without prior authorization, except where permitted by applicable law.
17. Third-Party Services and AI Providers
InstaHome may use or integrate third-party services, including:
- Artificial intelligence providers.
- Cloud infrastructure and storage providers.
- Authentication providers.
- Analytics services.
- Advertising networks.
- Payment processors.
- Apple App Store and Google Play services.
Third-party services may be governed by their own terms and privacy policies.
To the extent permitted by applicable law, InstaHome is not responsible for third-party services outside our reasonable control.
18. Privacy and Data Processing
Your privacy is important to us. Information about how we collect, process, store, use, and disclose personal information is provided in the InstaHome Privacy Policy.
InstaHome processes photographs and other User Content to provide AI-powered functionality. You should review the Privacy Policy carefully to understand how your personal information and User Content may be collected, processed, stored, used, and disclosed before using the Services or uploading User Content.
By using InstaHome, you acknowledge that information may be processed as necessary to provide, secure, maintain, and improve the Services in accordance with applicable law and our Privacy Policy.
19. Service Availability and Changes
AI-based services depend on computational resources, third-party providers, network availability, and other technical systems.
We do not guarantee that every feature will always be available, uninterrupted, or error-free.
We may modify, update, replace, limit, suspend, or discontinue features when reasonably necessary for technical, security, legal, commercial, or operational reasons.
Where required by applicable law, we will provide appropriate notice of material changes.
20. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided "AS IS" and "AS AVAILABLE."
InstaHome makes no guarantee that:
- The Services will always be uninterrupted or error-free.
- AI Outputs will be accurate or unique.
- Generated designs will be technically or structurally feasible.
- AI Outputs will meet every user's expectations.
- Every feature will remain permanently available.
To the extent permitted by law, InstaHome disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
21. Limitation of Liability
To the maximum extent permitted by applicable law, InstaHome and its affiliates, directors, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.
This includes, where legally permissible, losses arising from reliance on AI-generated designs, loss of data, loss of profits, or inability to access the Services.
To the maximum extent permitted by applicable law, InstaHome's aggregate liability arising from or relating to the Services will not exceed the amount you paid to InstaHome for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
22. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless InstaHome and its affiliates, officers, employees, and service providers from claims, liabilities, damages, and reasonable costs resulting from:
- Your unlawful use of the Services.
- Your material violation of these Terms.
- User Content you upload without the necessary rights or permissions.
- Your infringement of another person's intellectual property, privacy, or other legal rights.
This provision applies only to the extent permitted by applicable consumer protection laws.
23. Suspension and Termination
We may suspend, restrict, or terminate access to all or part of the Services if we reasonably determine that you:
- Materially violated these Terms.
- Used the Services fraudulently or unlawfully.
- Abused Credits or Rewarded Ads.
- Attempted to circumvent payment or subscription systems.
- Compromised the security or operation of the Services.
- Created a significant risk to InstaHome, other users, or third parties.
You may stop using InstaHome at any time.
Termination does not automatically entitle you to a refund except where required by applicable law or applicable app-store policies.
24. Copyright and Intellectual Property Complaints
If you believe that content available through InstaHome infringes your intellectual property rights, please contact us at support@insta-aigo.com
Your notice should provide sufficient information for us to identify the protected work, locate the allegedly infringing material, understand the basis of your claim, and contact you.
We may request additional information where necessary to evaluate the complaint.
25. Changes to These Terms
We may update these Terms from time to time to reflect changes in:
- InstaHome features.
- AI technologies.
- Subscription or Credit systems.
- Applicable laws and regulations.
- Third-party services.
- Security or operational requirements.
Where required by law, we will provide notice of material changes.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
If you do not agree to updated Terms, you should stop using the Services.
26. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.
The remaining provisions will continue in full force and effect.
27. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented for specific features, subscriptions, promotions, or purchases, constitute the agreement between you and InstaHome regarding your use of the Services.
28. Governing Law and Disputes
These Terms and any dispute arising out of or relating to the Services will be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict-of-laws principles, except to the extent that applicable mandatory law provides otherwise.
We do not represent or warrant that the Services are appropriate or available for use in every jurisdiction. If you access or use the Services from outside China, you are responsible for complying with the laws and regulations applicable to your use of the Services in your jurisdiction.
You and InstaHome agree that disputes arising out of or relating to these Terms or the Services will be subject to the jurisdiction of the courts designated under applicable law, except where applicable law provides otherwise.
Nothing in these Terms limits or excludes any consumer protection rights or other mandatory rights that you may have under the laws applicable to you.
